Trade disputes between importers and exporters may be resolved through a mediation chamber, rather than necessarily being judicialized. The aim is to speed up processes that can be costly and time-consuming in court for many years, and with mediation mainly benefit small and medium traders who do not have a sufficiently strong legal structure to wage international battles.
The news was released on Monday (26), by the Brazilian Foreign Trade Association (AEB), which will host the chamber, available to anyone who is associated or not to the entity. According to AEB Vice President Arthur Pimentel, there are thousands of foreign trade dispute cases in the Brazilian courts, which take years to resolve.
“Brazil is currently experiencing a culture change in the area of dispute settlement in foreign trade. The whole world is moving in this direction. Trying to divert the focus of Justice, which has a lot of demand, and especially to meet the medium and small companies, because large companies are better able to look for solutions out there, ”said Pimentel.
According to Pimentel, the chamber will be a space of confidentiality, focused on private companies, in Brazil and abroad, seeking speed and economy of resources, making the process much less costly than the judicial path. Cases that will be addressed by the chamber range from problems with product delivery, which may have some kind of defect or non-compliance with the order placed, to problems with exchange, payments or port procedures, among others.
